Terms of Service

1. Eligibility

To use Outty, you must:

• Be at least 18 years old;

• Have legal capacity to enter into this contract;

• Provide accurate and current information when creating an account;

• Use the Service only in compliance with this Agreement and all applicable laws.

We may refuse, suspend, or terminate access to the Service for individuals previously removed, violating the Agreement, or posing a risk to the community.

2. Access and Use of the Service

2.1 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Outty for your personal, non-commercial use.

All rights not expressly granted are reserved by the Company.

2.2 Service Changes and Availability

We may:

• Add, modify, or remove features;

• Perform updates or maintenance;

• Suspend or discontinue the Service;

• Restrict access temporarily or permanently.

We are not liable for any losses resulting from changes, downtime, or service unavailability.

3. Restrictions

You agree not to, and will not assist or allow others to:

1. Use the Service for any unlawful, harmful, or abusive purpose.

2. Harass, stalk, threaten, or harm other users.

3. Upload content that is violent, hateful, discriminatory, explicit, misleading, or illegal.

4. Impersonate another person or misrepresent your identity.

5. Disassemble, reverse engineer, decode, or copy any part of the Service.

6. Use bots, scrapers, automated tools, data mining systems, or similar technologies.

7. Disrupt server stability, interfere with performance, or attempt unauthorized access.

8. Collect or harvest data from the Service without permission.

9. Use the Service for benchmarking or competing product development.

10. Upload malware, viruses, or malicious code.

11. Share account credentials or bypass security mechanisms.

12. Use the Service to advertise or engage in commercial activities without written permission.

Violation may result in account suspension, termination, or legal action.

You are responsible for:

• Maintaining the confidentiality of your login credentials;

• All activities occurring under your account;

• Using a strong password and keeping your information updated.

We are not liable for losses resulting from unauthorized access to your account.

By creating an account, you agree to receive:

• Service-related notifications (required);

• Optional promotional communications (opt‑out available).

4.3 Account Ownership and Control

Outty retains control over all usernames, account identifiers, and data stored on its servers.

We may remove or restrict accounts at our discretion, subject to legal obligations.

 

5. User Content

5.1 Ownership

You retain ownership of all content you upload (“User Content”).

5.2 License to Outty

By posting or uploading User Content, you grant Outty a limited, worldwide, royalty‑free, revocable license to:

• Host, store, display, and reproduce the content;

• Process it technically to operate and improve the Service;

• Show it to other users according to your settings.

We may remove or restrict User Content that violates this Agreement.

5.3 Responsibilities Regarding Content

You represent and warrant that:

• You own or have permission to use all content you upload;

• Your content does not infringe third‑party rights or violate laws;

• You assume all risks associated with your content.

6. User Data

Outty collects and processes data as described in the Privacy Policy. By using the Service, you authorize us to:

• Process your data to operate the Service;

• Use aggregated and anonymized data for analytics, safety, and improvement.

We do not claim ownership of personal data and adhere to international privacy regulations.

7. Real‑World Interactions & Safety

Outty helps users discover people and activities nearby. We do not:

• Conduct criminal background checks;

• Verify identities beyond basic registration information;

• Guarantee user behavior or safety.

You are solely responsible for your safety during real‑world interactions. Outty disclaims liability for any injury, dispute, or harm arising from interactions with other users.

8. Service Modifications

We may change, upgrade, or discontinue features at any time. Continued use after changes constitutes acceptance of updated Terms.

9. Third‑Party Services and Integrations

The Service may integrate with third‑party providers such as:

• AWS (hosting)

• Analytics tools

• Future commercial partners

We do not control or endorse third‑party services and are not responsible for their actions, policies, or content.

10. Intellectual Property

All trademarks, logos, software, and materials provided by Outty are owned or licensed by the Company.

You may not copy, distribute, modify, or use Outty’s intellectual property without written permission.

11. Indemnification

You agree to indemnify and hold harmless the Company, its employees, and partners from claims, damages, losses, or expenses arising from:

• Your use of the Service;

• Your violation of these Terms;

• Your User Content;

• Your interactions with other users;

• Your breach of any law or right of a third party.

12. Limitation of Liability

To the maximum extent permitted by law, Outty is not liable for:

• Indirect or consequential damages;

• Losses resulting from interactions with users;

• Unauthorized access to your data;

• Service interruptions, errors, or system failures.

Our total liability will not exceed the amount you paid for the Service, if any.

13. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind. We do not guarantee uninterrupted access, error‑free operation, or perfect security.

14. Governing Law

This Agreement is governed by the laws of Brazil, with exclusive jurisdiction in the courts of São Paulo, SP.

15. General Provisions

• Entire Agreement: These Terms constitute the full agreement between you and Outty.

• Severability: If any provision is invalid, the remaining terms remain in effect.

• No Waiver: Failure to enforce a term does not constitute waiver of rights.

• Assignment: You may not assign rights; we may assign this Agreement as needed.

• Notices: We may provide notices via email or within the app.
